Terms

Effective [EFFECTIVE DATE]

These terms are an agreement between you and [LEGAL NAME / ADDRESS] (“NextBend”, “we”, “us”) for using the NextBend app, our server and this website. By using NextBend you agree to them. Our privacy policy explains how we handle your data.

An alpha, as is

  • NextBend is alpha software, shared with a small group of riders through TestFlight to test it. It is unfinished: features may change, break, or be removed, and recordings may be incomplete or wrong.
  • It is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and uninterrupted availability, to the extent the law allows.
  • Keep your own copy of anything that matters to you — you can share any journey as a GPX file.

Ride safely

  • Never use your phone while riding. Start, stop and review journeys only when you have safely stopped.
  • Mount your phone securely if you carry it on the bike, and never let the app distract you.
  • Ride safely and legally: follow traffic laws, wear proper gear, and hold a valid licence and insurance for your bike.
  • NextBend is not a navigation or safety device. Don’t rely on it for directions, speed, distance, fuel or emergencies. Places it suggests are not checked by us; judge for yourself whether a place is open, safe or suitable.

Your account

  • You must be 18 or older to use NextBend.
  • You sign in with Apple or Google. One account per person; keep your Apple ID or Google account secure, because anyone who can use it can use your NextBend account.
  • You’re responsible for what happens in your account. Tell us at [CONTACT EMAIL] if you think someone else has used it.
  • You can delete your account at any time — see Delete your account.

Acceptable use

Don’t:

  • use NextBend to break the law, or to track or record anyone without their consent;
  • upload content that is unlawful, abusive or that you have no right to share;
  • access our server other than through the app, probe or overload it, get around its limits or security, or reverse-engineer the app or the API, except where the law allows;
  • share your TestFlight invitation or access with others, or copy, sell or resell the service.

We may suspend or close an account that breaks these terms, and will tell you why unless the law prevents us.

Your content

Your journeys, stops, bikes and other content stay yours. You give us permission to store, process and display them only to run NextBend for you, as described in the privacy policy. That permission ends when you delete the content or your account, except for copies in backups until they are deleted.

If you send us feedback or ideas, we may use them to improve NextBend without owing you anything.

Other services

NextBend uses Sign in with Apple, Google Sign-In, Google Maps and Google Places. Your use of those is also subject to Apple’s and Google’s own terms. Map data and place information come from Google; we don’t guarantee they are accurate.

Ending the alpha

We may change, pause or end the alpha, or the whole service, at any time. If we end it, we will try to give you notice by email or in the app, and a chance to export your data first. You can stop using NextBend at any time.

Liability

To the extent the law allows, NextBend is not liable for indirect, incidental or consequential losses, lost data, or for accidents, injuries, fines or damage arising from riding, or from relying on the app. Our total liability to you is limited to the amount you have paid us for NextBend, which during the free alpha is nothing. Nothing in these terms limits liability that cannot be limited by law.

Governing law

These terms are governed by the laws of India. Courts at the place of [LEGAL NAME / ADDRESS] have exclusive jurisdiction, subject to any rights you have as a consumer under Indian law.

Changes

We may update these terms as the alpha develops. We will change the effective date above and, for important changes, tell you in the app or by email before they apply. If you keep using NextBend after that, the new terms apply.
